Terms of Service

The rules that apply when you browse, listen, or contribute content to Streamitter.

These Terms of Service (“Terms”) govern your access to and use of Streamitter’s website, directory, and related services (the “Services”). Please read them carefully. These Terms are a general template; adapt them for your business and seek legal advice where appropriate.

1. Agreement

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Eligibility

You must be able to form a legally binding contract in your jurisdiction and meet any minimum age we specify. You may not use the Services if you are prohibited from doing so under applicable law.

3. Description of the Services

Streamitter provides an online directory of radio stations, metadata, links, and tools that may allow you to discover and listen to third-party audio streams. We do not operate or control the underlying broadcasts. Stream availability, quality, and legality in your location are determined by third parties and local law.

4. Accounts

Some features require an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms or pose a risk to the Services or other users.

5. Acceptable use

You agree not to:

  • Use the Services in any way that violates applicable law or infringes others’ rights.
  • Attempt to gain unauthorised access to our systems, other users’ accounts, or data.
  • Interfere with or disrupt the Services (including introducing malware, overloading infrastructure, or circumventing security).
  • Use automated means (e.g. scraping, bots) in a manner that impairs the Services or breaches our technical policies, except as expressly permitted.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Harvest or collect personal data about users without consent.

We may investigate violations and cooperate with law enforcement where appropriate.

6. Station listings, content, and submissions

If you submit or manage station listings, logos, descriptions, or other content (“User Content”), you represent that you have the rights to provide it and that it is accurate and lawful. You grant Streamitter a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute User Content as reasonably necessary to operate, promote, and improve the Services. You retain ownership of your User Content subject to that licence.

We may review, refuse, edit, or remove listings or content at our discretion, including for quality, duplication, policy compliance, or legal reasons. We are under no obligation to host any particular station or content.

7. Intellectual property

The Services, including design, branding, software, and original editorial content, are owned by Streamitter or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you. Trademarks and logos of third-party stations remain the property of their respective owners.

8. Third-party services

The Services may link to or embed third-party websites, players, or streams. Those services are governed by third-party terms and privacy policies. We are not responsible for third-party content, advertising, or practices.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or that streams or information are accurate or lawful in your jurisdiction.

10. Limitation of liability

To the fullest extent permitted by applicable law, Streamitter and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from your use of the Services or inability to use them, even if advised of the possibility. Our aggregate liability for claims arising out of the Services shall not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months before the claim or (b) one hundred (100) units of your local currency, if you are a consumer using free Services.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

11. Indemnity

You agree to indemnify and hold harmless Streamitter and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

12. Suspension and termination

We may suspend or terminate access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or harms the Services or others. You may stop using the Services at any time. Provisions that by their nature should survive (e.g. intellectual property, disclaimers, limitations, indemnity) will survive termination.

13. Changes to the Terms

We may modify these Terms by posting an updated version on this page. If changes are material, we may provide additional notice. Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.

14. Governing law and disputes

Unless mandatory law provides otherwise, these Terms are governed by the laws of the country or region in which the operator of Streamitter is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence require otherwise. Subject to those mandatory rules, disputes shall be brought in the courts of that jurisdiction.

15. General

If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and Streamitter regarding the Services and supersede prior agreements on the same subject.
